AUVEQ B.V. respects your privacy and handles personal data with care. In this privacy statement, we explain which personal data we process, why we do so, with whom we share data, how long we store data, and what rights you have.

This privacy statement applies to auveq.com, AUVEQ Explore, and AUVEQ Selected.

For personal data processed during the use of the AUVEQ WhatsApp Assistant, an additional privacy statement may also apply.


1. WHO IS RESPONSIBLE?

AUVEQ B.V. is responsible for the processing of personal data as described in this privacy statement.

AUVEQ is exclusively intended for individuals aged 18 and older.


2. WHAT PERSONAL DATA DO WE PROCESS?

The data we process depends on how you use AUVEQ.

We may process, among others, the following personal data:

  • name;
  • email address;
  • phone number;
  • account and membership data;
  • billing details;
  • payment and transaction data;
  • communication with AUVEQ;
  • information you provide in a Request;
  • preferences regarding restaurants, hotels, and accommodations;
  • technical data such as IP address, browser, device, and log data;
  • cookie and analytics data;
  • advertising and conversion data;
  • marketing and communication preferences.

For payments, we only receive the data necessary for processing and managing payments and subscriptions.

AUVEQ does not store full payment card details itself. Their processing takes place via our payment provider.

We receive data directly from you, automatically when you use our website or services, and, where necessary, from service providers involved in our service delivery.

Special categories of personal data

A Request may contain information about, for example, allergies, intolerances, or other circumstances that may indicate something about your health.

Health data are special categories of personal data and receive extra protection under the GDPR.

AUVEQ processes such data only when necessary for the service you requested and when there is a valid legal basis for it. Where explicit consent is required, we will request it separately.

You are not obliged to provide health data.

We do not use health-related data for general marketing or advertising profiling.


3. WHY DO WE PROCESS YOUR DATA?

We process personal data only when there is a valid legal basis for doing so.

Account and membership

We use your data to:

  • create an AUVEQ account;
  • activate Explore or Selected;
  • manage your membership status;
  • provide access to our services;
  • link your account to other parts of AUVEQ;
  • communicate with you about your membership.

This is generally necessary to perform our agreement with you or to take steps at your request before entering into an agreement.

AUVEQ Recommend and Check

When you ask AUVEQ to find or review a restaurant, hotel, or accommodation, we process the information from your Request to provide the service.

For example, we can take into account:

  • destination;
  • budget;
  • atmosphere;
  • occasion;
  • company;
  • cuisine;
  • amenities;
  • pets;
  • accessibility;
  • other preferences you specify.

This processing is necessary to perform the AUVEQ services.

Payments and subscriptions

When you subscribe to Selected, we process necessary payment and transaction data to:

  • process payments;
  • manage your subscription;
  • check payment statuses;
  • process refunds;
  • maintain invoices and financial administration.

Part of this is necessary for the performance of the agreement. Other data we must retain to comply with legal, e.g., tax, obligations.

Contact and customer service

When you contact AUVEQ, we process the information you provide to handle your question, request, or complaint.

Depending on the situation, we do this because it is necessary for our agreement with you or due to our legitimate interest in supporting users and properly managing our services.

Security and fraud prevention

  • We may use technical, account, and transaction data to:
  • prevent fraud;
  • detect abuse;
  • secure accounts and systems;
  • investigate security incidents.

We do this based on our legitimate interest in protecting AUVEQ, our users, and our systems.

Marketing

We may send you news, updates, and offers from AUVEQ when there is a valid legal basis for it.

Where consent is required, we will request it separately.

Creating an account or subscribing to Selected does not automatically mean you sign up for marketing.

You can unsubscribe at any time via the unsubscribe link in our messages.

Analytics and advertisements

With your consent, when legally required, we may also use personal data and technologies such as cookies to:

  • analyze website usage;
  • improve our services;
  • measure conversions;
  • analyze advertising performance;
  • make advertisements more relevant;
  • retarget previous visitors with AUVEQ advertisements.

You can manage your preferences via our cookie settings.


4. PROFILE DATA AND REQUESTS

Information you provide during a Request may be used to help AUVEQ better understand what you are looking for.

This may include processing, for example, location, price level, atmosphere, occasion, and practical preferences.

AUVEQ uses this information to enable Recommend, Check, and other parts of our services.

Information from different Requests may be linked to your account when necessary or useful for the service and compatible with the purpose for which the information was collected.

We do not automatically use information from your Requests to build a general advertising profile about you.


5. PAYMENTS AND FRAUD PREVENTION

For payments and subscriptions, we may use Stripe.

This may include processing, among other things:

  • payment amount;
  • date;
  • payment method;
  • transaction status;
  • customer identification;
  • fraud and risk indicators.

Stripe may use automated systems to assess fraud and payment risks. This may, for example, lead to a payment being rejected or selected for additional review.

AUVEQ itself does not make decisions with legal or similarly significant consequences based solely on automated processing, unless legally permitted and appropriate safeguards are in place.

6. EMAIL AND MARKETING

AUVEQ may use Klaviyo for, among other things:

  • customer profiles;
  • communication preferences;
  • email communication;
  • newsletter subscriptions;
  • unsubscriptions;
  • marketing.

The existence of a customer profile in Klaviyo does not automatically mean you have consented to marketing.

Where consent is needed, we will request it separately.

You can stop marketing communications at any time via the unsubscribe link in our messages.

We may retain limited information about an unsubscribe to ensure your preference is respected.


7. COOKIES, ANALYTICS, AND ADVERTISEMENTS

We use necessary cookies and similar technologies to ensure our website functions securely and technically well.

With consent, when legally required, we may also use technologies for analytics, conversion measurement, advertisements, and retargeting.

We may use, among others, the following:

  • Google;
  • Meta;
  • Microsoft Clarity;
  • Klaviyo.

Technologies requiring prior consent are not activated until this consent has been given.

Via our cookie settings, you can:

  • accept cookies;
  • reject non-essential cookies;
  • set your preferences by category;
  • change or withdraw previously given consent.

8. WITH WHOM DO WE SHARE PERSONAL DATA?

AUVEQ does not sell your personal data.

For the performance of our services, we may have personal data processed by service providers such as:

Shopify
For our website, checkout, and customer accounts.

Stripe
For payments, subscriptions, and fraud prevention.

Exact Online
For financial administration and accounting.

Supabase
For account, customer, and membership infrastructure.

Klaviyo
For customer communication, preferences, and email marketing.

Google
For analytics, ad measurement, and advertisements, depending on your cookie choices.

Meta
For advertisements, conversion measurement, and the WhatsApp infrastructure where relevant.

Microsoft Clarity
For analyzing website usage, when consent has been given for this.

For the AUVEQ WhatsApp Assistant, systems such as n8n, Sleak, Supabase, and WhatsApp/Meta may also be involved.

Depending on the processing, these parties act as processors, independent controllers, or in some cases joint controllers.

Where required by law, we conclude appropriate agreements regarding the processing of personal data.


9. RESTAURANTS, HOTELS, AND EXTERNAL PARTIES

When AUVEQ recommends a restaurant, hotel, or other external provider, we do not automatically share your full account details with that party.

If you then make a reservation yourself via an external website, booking service, or directly with the Location, you provide personal data directly to that party.

That external party processes this data primarily under its own responsibility and according to its own privacy terms.

If AUVEQ, in the future, forwards personal data on your behalf to an external provider to facilitate a specific reservation or request, we will inform you of this beforehand where necessary.


10. INTERNATIONAL DATA TRANSFERS

Some service providers used by AUVEQ may process personal data outside the European Economic Area or make it accessible.

When personal data is transferred outside the EEA, we use a legally permitted mechanism for international transfers where required.

This may include, for example:

  • an adequacy decision by the European Commission;
  • the EU-US Data Privacy Framework for participating organizations; or
  • Standard Contractual Clauses of the European Commission, possibly supplemented with additional safeguards.

11. HOW LONG DO WE RETAIN PERSONAL DATA?

We do not retain personal data longer than necessary for the purpose for which it was collected, unless we are required to retain data longer due to a legal obligation or other valid reason.

As a general principle, we use:

Account and membership data
As long as the account or membership is active and thereafter only as long as necessary for administration, disputes, or legal obligations.

Contact and customer service data
Generally a maximum of 24 months after the last relevant contact, unless longer retention is necessary.

Requests and preferences
No longer than necessary for providing and improving the relevant services.

Special categories of personal data
No longer than necessary for the purpose for which they were provided and, where possible, shorter than regular account data.

Marketing data
As long as you wish to receive marketing and thereafter only as far as necessary to register your unsubscription.

Financial administration
During the applicable legal tax retention period, generally seven years.

Technical, security, cookie, and analytics data
According to the retention period appropriate for the relevant purpose and system.

Deleted personal data may temporarily remain in secure backups until they are overwritten or deleted according to our normal backup cycle.


12. SECURITY

AUVEQ takes appropriate technical and organizational measures to protect personal data against, among other things:

  • loss;
  • misuse;
  • unauthorized access;
  • unlawful alteration;
  • destruction;
  • other unlawful processing.

Access to personal data is restricted to employees and service providers who need this data for their work.

Where personal data is more sensitive, we take this into account in our security measures.

No digital system can guarantee absolute security.


13. YOUR PRIVACY RIGHTS

Depending on the circumstances, under the GDPR, you have the right to, among other things:

  • access your personal data;
  • have incorrect data corrected;
  • have data deleted;
  • have processing restricted;
  • object to certain processing activities;
  • transfer personal data in certain cases;
  • withdraw consent when processing is based on it.

You can always object to the use of personal data for direct marketing.

We generally respond within one month. If the GDPR allows this period to be extended, we will inform you within the original period.

If necessary to verify your identity, we may ask for additional information.

The right to erasure is not absolute. Data that we must retain, for example, due to tax legislation, cannot be immediately deleted.


14. COMPLAINT TO THE DUTCH DATA PROTECTION AUTHORITY

Do you have questions or complaints about how AUVEQ processes personal data? Please preferably contact us first so that we can investigate the situation.

You also have the right to file a complaint with the Dutch Data Protection Authority.


15. CHANGES TO THIS PRIVACY POLICY

Our services, systems, and suppliers may change. Therefore, we may amend this privacy statement from time to time.

The current version will be published on our website. The date of the last update will be stated at the top.

If a change has significant consequences for how we process existing personal data, we will inform affected individuals when required by the GDPR.

An amendment to this privacy statement does not automatically grant AUVEQ the right to use existing personal data for new and incompatible purposes.
